TO: Jeremy TOIVONEN cc Aus Sports Commission
General Manager NSW Premiers Department
MANLY WARRINGAH FOOTBALL ASSOCIATION Soccer NSW, PRSLFC
Dear Mr TOIVONEN
COMPLAINT ABOUT PRSLFC HEARING PROCESS
As, unfortunately, Australia's participation in the Football World Cup
has come to an end, this is to register a complaint about the hearing
before the Pittwater RSL Football Club Management Committee on
Wed 14 Jun 2006.
The hearing was not about the 9 Complaints listed in the letter from
the President dated 18 May 2006 and received Fri 02 Jun 2006 and
responded in writing on Tue 13 Jun 2006.
REF: Response to Breach of Duty Allegations
The hearing was about the Minutes dated Wed 12 Apr 2006 and
specifically Item 15 General Business whereby the President
stated:
1 "that he had requested Stephen GOULD "not to send emails
to any member of the Club".
2 "Stephen GOULD has agreed not to send any emails".
At the meeting the Management Committee demanded that I
refrain from sending emails to any member of the Club.
I refused because I said Pittwater RSL Football Club was not following
the Duty of Care guide-lines for Junior Sports principles such as those
defined on the Australian Sports Commission web site for Juniors.
I HAD REQUESTED COPIES OF THOSE MINUTES TWO TIMES
TO CHECK IF THE MINUTES HAD RECORDED THE COMPLAINT
LODGED BY ONE OF THE UNDER 8 PLAYERS PARENTS.
REF: Two e-mails requesting copy minutes
Those minutes were not sent to me because:
1 I would have refuted the minutes and
2 said the Management Committee was not following the Duty of
Care Guide-lines for Junior sportspeople.
3 asked what response had been received to the Complaint from
the U8 Players' parents dated 31 Mar 2006 and reported to the
Management Committee on 12 Apr 2006
I gave each person a copy of the Index of the Minutes received and
not received as at 14 Jun 2006.
I do not appreciate being "ambushed" over Minutes under the guise
"failing to fulfil the duties of the U8 Age Co-ordinator"
NEXT STEPS
According s26(i) of the extract of the Constitution that was given to
me at the meeting, I have 7 days to Appeal after I have received
Notice of the Resolution agreed at that meeting.
I have not received the Notice of that Resolution hence my email
on Fri 23 Jun 2006 requesting what to do if I did not receive a
copy of that Resolution ?
If the MWFA is serious about developing the right Culture in
Junior Football then the MWFA has to set right example by assisting
Junior Football Clubs to follow the Guide-lines developed by the
Australian Sports Commission.
As I and my colleagues have devoted over 300 man hrs to specifying
the Job Descriptions for Amateur Football Clubs it may be appropriate
for MWFA or Soccer NSW to evaluate the work carried out of Job
Descriptions for Volunteer Football Clubs that have the Internet.
In addition the MWFA may want to evaluate the real benefits to
Volunteer Football Clubs of the OIC Electronic Committee Information
Management [ECIM] process particularly for effective Dispute
Resolution issues.
There will be 3 other complaints filed.
Yours sincerely
Stephen GOULD
